  1. Acceptance of these Terms
    By accessing or using EduCourse (“we”, “us”, “our”, “EduCourse”) websites, mobile pages, emails, and services (together, the “Service”), you agree to these Terms of Use (“Terms”). If you do not agree, do not use the Service.
  2. Who may use EduCourse
    – You must be at least 16 years old or have verifiable consent from a parent or legal guardian if your local law requires it.
    – You must be able to form a binding contract.
    – If you use the Service on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.
  3. Your account
    – You are responsible for any activity that occurs under your account. Keep your credentials secure.
    – Provide accurate information and keep it up to date.
    – Do not share or transfer your account. We may suspend or terminate accounts that violate these Terms.
  4. Courses, learning content, and certificates
    – EduCourse offers free, self-paced learning content. Certificates indicate course completion as determined by EduCourse’s rules and may require identity verification.
    – Certificates are not academic degrees, professional licences, or guarantees of employability.
    – We may change, withdraw, or re-issue a certificate if we detect error, misconduct, or fraud.
    – We may add, modify, or remove courses, modules, assessments, and features at any time.
  5. Identity and verification
    – To issue certain certificates or prevent misuse, we may ask you to verify your identity (for example, providing a name match to an ID).
    – You consent to our processing of that information for verification and fraud-prevention, as described in our Privacy Notice. If verification fails or is refused, we may withhold or revoke a certificate.
  6. Your content and conduct
    – “User Content” means anything you submit or upload (for example, profile info, discussion posts, feedback).
    – You grant EduCourse a non-exclusive, worldwide, royalty-free licence to host, use, reproduce, and display your User Content to operate and improve the Service.
    – You must not submit anything unlawful, abusive, infringing, deceptive, or harmful, and you must not:
    • cheat on assessments, attempt to obtain answers dishonestly, or help others to do so
    • copy, scrape, or bulk-download course materials except as allowed for personal study
    • reverse engineer or attempt to bypass security or access controls
    • use the Service to send spam or unauthorised communications
    • impersonate another person or misrepresent your affiliation
    – We may remove User Content or take action if we reasonably believe there is a breach.
  7. Licence to use EduCourse
    – We grant you a limited, personal, non-transferable, non-exclusive licence to access and use the Service for your own learning, subject to these Terms.
    – Except for that licence, we and our licensors retain all rights in the Service and its content.
  8. Intellectual property
    – All logos, names, course materials, videos, text, graphics, and software on the Service are protected by law and belong to EduCourse or its licensors.
    – You may not use our marks or content except as permitted by these Terms or with our prior written consent.
  9. Communications and email
    – We may send you transactional or service emails (for example, account notices, course updates).
    – Marketing emails are optional; you can unsubscribe using the unsubscribe link in our emails or via your account settings. Unsubscribing from marketing does not stop essential service emails.
  10. Third-party services and links
    – The Service may contain links to third-party sites or services. We are not responsible for their content, policies, or availability. Use them at your own risk.
  11. Availability and changes
    – The Service may be modified, suspended, or discontinued (in whole or in part) at any time.
    – We aim for high availability but do not guarantee the Service will be uninterrupted or error-free.
  12. Payments (if applicable)
    – Most courses are free. If we offer paid options or add-ons, pricing, taxes, and billing terms will be shown at checkout and form part of these Terms.
  13. Prohibited uses
    You agree not to use the Service:
    – for any unlawful purpose
    – to attempt to gain unauthorised access to systems or data
    – to upload malware or perform security scanning without permission
    – to harvest personal data without consent
    – to infringe the rights of others (including privacy and IP rights)
  14. Feedback
    – If you give us ideas or suggestions, you grant EduCourse a perpetual, worldwide, royalty-free licence to use them without obligation to you.
  15. Termination
    – You may stop using the Service at any time.
    – We may suspend or terminate your access immediately if you breach these Terms, create risk or legal exposure for us, or where required by law.
    – Upon termination, the licence granted to you ends and you must stop using the Service. Sections intended to survive will continue (for example, IP, disclaimers, liability limits).
  16. Disclaimers
    – The Service and all content are provided “as is” and “as available” without warranties of any kind, express or implied.
    – We do not warrant that the Service will meet your requirements, be accurate, or be available at all times.
  17. Limitation of liability
    – To the maximum extent permitted by law, EduCourse will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to your use of the Service.
    – Our total liability for any claim is limited to the greater of (a) ZAR 1,000 or (b) the total amount paid by you to EduCourse (if any) in the 12 months before the claim.
  18. Indemnity
    – You agree to indemnify and hold harmless EduCourse from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms or misuse of the Service.
  19. Privacy
    – Your use of the Service is also governed by our Privacy Notice, which explains how we collect and process personal information and your rights.
  20. Governing law and disputes
    – These Terms are governed by the laws of South Africa, without regard to conflict-of-laws rules.
    – You and EduCourse submit to the exclusive jurisdiction of the courts of South Africa for any dispute arising out of or relating to these Terms or the Service.
    – Before filing a claim, both parties agree to try to resolve the dispute informally within 30 days after written notice.
  21. Changes to these Terms
    – We may update these Terms from time to time. We will post the updated Terms with a new “Last updated” date. Changes take effect when posted. If you continue to use the Service after changes are posted, you accept the updated Terms.

  23. General
    – These Terms, together with any policies referenced here, are the entire agreement between you and EduCourse regarding the Service.
    – If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
    – You may not assign these Terms without our consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
    – No failure or delay to enforce a provision is a waiver of our right to do so later.
